THE UNDERSIGNED PARTIES, REPRESENTATIVES OF PARTIES AND THEIR RESPECTIVE ATTORNEYS AND ANY OTHER PERSONS PRESENT AT THIS MEDIATION UNDERSTAND AND AGREE AS FOLLOWS:
  1. This proceeding is CONFIDENTIAL AND PRIVILEGED as settlement negotiations.
  2. The Mediator is a NEUTRAL and is not giving legal advice or analyzing any party's legal rights.
  3. Florida Law pertaining to Mediation shall apply, including, but not limited to:
    • Florida Statutes Section 44.102(3) which states:

      "Each party in the mediation proceeding has a privilege to refuse to disclose, and to prevent any person present from disclosing communication."
    • Florida Statutes Section 44.107 which states:

      "....a mediator shall have judicial immunity in the same manner and to the extent as a judge."
